Terms of Service
These Terms govern your use of EasePop. By accessing or using our services, you agree to be bound by these Terms.
“EasePop”, “easepop.dev”, “we”, “us”, and “our” refer to the popup services provided by EasePop.
Please also review our Privacy Policy, which explains how we handle your information.

Changes to These Terms
We continually improve our services and may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on our website, sending an email, or by other reasonable means. If you do not agree to the revised Terms, you may reject them, but you must stop using the services. Your continued use of the services after the changes become effective constitutes acceptance of the updated Terms. Any decision by us not to exercise a right under these Terms does not waive that right.
Accounts and Eligibility
- You must create an account with a valid email address and activate it via the confirmation link sent to you.
- You represent and warrant that you are of legal age and capacity to form a binding contract. If you use the services on behalf of an organization, you represent and warrant that you are authorized to bind that organization to these Terms.
- You must provide accurate, complete, and current information and keep it updated. You may not use false information, impersonate another person, or transfer your account without our written permission.
- You are responsible for safeguarding your credentials and for all activity under your account.
Subscriptions, Trials, and Billing
Paid subscriptions begin on the date of payment and renew monthly unless canceled. Current plan details and pricing are available at our payment page. Payments are processed by our payment provider Creem; see Creem Terms. We may change prices at our discretion, with changes applying on your next billing cycle unless otherwise stated.
Prices, Taxes, and Invoices
Our website displays prices exclusive of VAT. At checkout, our payment processor shows the final price inclusive of applicable taxes and fees. For EU customers, VAT is applied according to applicable rules. If you provide a valid EU VAT ID for a B2B purchase, the reverse charge mechanism may apply where legally available. Invoices include required VAT information.
We may offer a free trial as described during signup. We do not require a credit card for the trial and we do not sell your data. After the trial ends, advance payment is required to continue using the service. If payment is not made, your account will be frozen and inaccessible until payment is completed.
The number of pageviews and user submissions included in a paid plan must be used within the billing term; unused quantities expire at the end of the term and do not roll over, except as explicitly stated for overage handling below.
Traffic Spikes and Quotas
We do not charge unexpected fees for occasional traffic spikes. If your pageviews exceed your plan’s quota, popups will stop displaying until either you upgrade or the quota resets at the start of your next billing cycle.
If your submissions exceed your plan’s quota, new submissions will continue to be recorded, but access to those excess submissions will be locked until you upgrade or your next billing period begins. Any excess submissions may be deducted from the next month’s quota.
Plan Changes and Cancellations
You may upgrade, downgrade, or cancel your subscription at any time from your account settings. Upgrades generally take effect immediately; downgrades and cancellations generally take effect at the end of the current billing period unless otherwise stated. Any proration, if applicable, will be described during the change flow.
Downgrading plans may reduce or remove features, limits, storage, or access to historical data. You are responsible for exporting or backing up your data before making such changes. To the maximum extent permitted by law, we are not liable for any loss of features, data, revenue, or business resulting from a downgrade or cancellation initiated by you.
Canceling your subscription stops future renewals. Your access will remain active through the end of your paid period. Your account data becomes inaccessible and popups will stop displaying. Your data will be stored for as long as you keep your account active.
Consumer Right of Withdrawal
If you are a consumer in the EU/EEA, you have a 14‑day right to withdraw from your initial subscription. By creating, configuring, or publishing a popup, you acknowledge and expressly agree that performance begins during the withdrawal period and that the right of withdrawal may be lost for the period fully performed. To exercise your right, contact us using the details on our Imprint or Contact page. Refund details will be provided where applicable.
Acceptable Use and Content Responsibilities
You are solely responsible for the content you configure and publish through the services on your website. You must not publish or solicit content that violates laws, regulations, or public policy, or that harms EasePop’s interests or reputation.
- Prohibited content includes material that is abusive, defamatory, discriminatory, obscene, pornographic, threatening, harassing, or that incites hatred or violence.
- Political or religious advocacy content is not permitted.
- Do not distribute unauthorized copies of materials protected by intellectual property, image, or privacy rights.
You warrant that you have all rights and permissions to use and publish your content and that you respect third‑party rights. You will indemnify and hold EasePop harmless from any third‑party claims, damages, and costs arising from your content or your use of the services. You must not modify another website to falsely imply an association with EasePop.
Acceptable Use of the Services
- Do not use the services for any unlawful purpose or in violation of these Terms.
- Comply with all applicable laws and regulations in your use of the services.
- Do not attempt to breach or circumvent the security of the platform or access areas or data without authorization.
- Protect your account by keeping credentials confidential. You are responsible for activities under your account.
- Do not upload malware, attempt to disrupt, overload, or interfere with the services, bypass rate limits, or scrape without consent.
- Do not reverse engineer or attempt to derive source code except to the extent permitted by applicable law.
Service Modifications and Availability
We may modify or discontinue any part of the services at any time, temporarily or permanently, with or without notice.
Service Level and Support
EasePop does not guarantee uninterrupted or error‑free operation and does not offer a binding service level agreement. Operation may be affected by factors outside our control, including equipment issues, hosting or provider disruptions, internet congestion, or force majeure events.
We test features carefully and prioritize fixes, especially for security and privacy. Not all reported issues will be resolved, and we do not guarantee completely error‑free services. Technical support is provided via email on a reasonable‑effort basis without guaranteed response times.
We may deprecate or change features. For material, breaking changes, we will provide reasonable advance notice where feasible, and may offer migration guidance. Unless a separate agreement states otherwise, no service credits are provided.
Authorized personnel may access your data to provide support, maintain and safeguard the platform, and ensure service security. We use third‑party vendors for infrastructure, storage, payment processing, and related services. See our list of subprocessors in our Privacy Policy.
Intellectual Property
You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the application or services without our prior written permission.
Termination
We may suspend or terminate your access to the services at any time, without notice, if your conduct violates these Terms or harms our operations or other users. Upon termination, your right to access the services ceases immediately.
To cancel your account, contact us via any of the methods listed on our contact page. We will provide instructions. The email alone does not complete cancellation.
If you terminate your account before the end of your current paid period, cancellation takes effect at the end of the billing cycle and you will not be charged again. After the paid period ends, your account data becomes inaccessible and popups will stop displaying. Data not legally required to be retained will be deleted and cannot be recovered.
Disclaimers and Limitation of Liability
The services are provided on an “as is” and “as available” basis. EasePop is not liable for graphical or typographical errors.
To the maximum extent permitted by law, EasePop and its affiliates, directors, and employees are not liable for any damages of any kind, including lost profits, lost business, loss of use or data, business interruption, or any direct, indirect, special, incidental, or consequential damages.
- We are not liable for errors, inaccuracies, or omissions in content.
- We are not liable for unauthorized access to servers or personal information.
- We are not liable for interruptions of the service or failures to perform.
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence. Mandatory consumer protection laws remain unaffected.
Notices
We may provide notices by email to your account email, in‑product messages, posting on our site, or postal mail to the address in your account or our Imprint. Notices are deemed received upon sending or posting.
Governing Law and Disputes
These Terms are governed by the laws of Austria, without regard to conflict of law principles. Exclusive jurisdiction and venue are the competent courts of Graz, Austria. If you are a consumer, mandatory consumer protections of your habitual residence remain unaffected.
You agree to resolve disputes with us in good faith. To the extent permitted by law, claims must be brought in an individual capacity and not as part of collective redress, unless collective mechanisms are mandated by applicable law.
If any provision of these Terms is held to be invalid or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the economic purpose of the invalid provision.
Export Control and Sanctions
You represent that you are not a person or entity subject to sanctions and that you will not use the services in violation of EU or applicable export control and sanctions laws.
Assignment and Survival
We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms, together with referenced documents, constitute the entire agreement between you and EasePop regarding the services. Provisions that by their nature should survive termination will survive, including intellectual property, indemnity, limitations of liability, payment obligations, data protection, and governing law.
